1. Agreeing to These Terms

Phins ("Phins", "we", "us") runs the website at phinsapp.com. These Terms of Use are an agreement between you and Phins. By visiting or using the site, you agree to these terms, to our Privacy Policy and to our Disclaimer. If you do not agree, please do not use the site.

2. What Phins Is

Phins is a forecasting and analytics site about mixed martial arts. A statistical model rates fighters and estimates how fights may go. Everything on the site is offered for general information and entertainment.

3. Not Betting, Financial or Professional Advice

Phins does not take bets, hold money for anyone, or act as a bookmaker, broker or advisor of any kind. Nothing on the site is a recommendation, an offer or an encouragement to bet, and nothing on it is financial, legal or other professional advice.

Any decision you make after reading the site is yours alone, and you carry the full risk of it. Betting is restricted or illegal in many places and for people under a minimum age; knowing and following the law where you live is your responsibility. If gambling is causing you or someone you know harm, in the United States you can call 1-800-GAMBLER.

4. No Guarantee of Accuracy

Forecasts are estimates and are often wrong. A fighter given a 70% chance loses about three times in ten. Ratings, statistics, records, dates, fight cards and results on the site may contain mistakes, may be out of date and may change without notice. Results shown while an event is in progress come from outside sources and can be late or incorrect. Past performance of the model, whether live or in a replay of past fights, does not promise anything about the future.

5. Who Can Use Phins

You must be at least 13 years old to use the site. If you are under 18, use it only with the permission of a parent or guardian. You may not use the site where doing so would break the law.

6. Accounts

When accounts are available, you agree to give accurate information, to keep your password private, and to be responsible for what happens under your account. Tell us right away at [email protected] if you think someone else has used it. We may suspend or close an account that breaks these terms, and you may ask us to close yours at any time.

7. Acceptable Use

You agree not to:

copy, scrape or download the site's forecasts, ratings or other content in bulk, by hand or with automated tools, without our written permission;
sell, republish or pass off the site's forecasts, ratings or text as your own, or build a competing product from them;
interfere with the site, try to get around its security, or put an unreasonable load on it;
use the site to break any law or to harm, harass or mislead anyone;
suggest that you or your product is connected with or endorsed by Phins when it is not.

You may quote a small amount of the site, such as a forecast or a rating, if you credit Phins and link to phinsapp.com.

8. Ownership

The Phins name and logo, the design of the site, the Fighter Elo ratings, the forecasts, and the text, graphics and code that make up the site belong to Phins and are protected by copyright and other laws. We give you a limited, personal, non-commercial permission to view the site. That permission ends if you break these terms. All rights not given here are kept by Phins.

9. Names, Trademarks and Material From Others

Phins is independent. It is not affiliated with, endorsed by or sponsored by the UFC, any other promotion, any fighter or any betting company. UFC and related names and marks belong to their owners. Names of events, organizations and fighters are used only to identify what a forecast or statistic is about.

Some material comes from other sources, which are credited on the Disclaimer and Credits page and remain subject to their own licenses. The site may link to or read from other websites. We do not control them and are not responsible for what is on them.

10. Feedback

If you send us ideas, corrections or other feedback, you agree that we may use them freely, without owing you anything.

11. Provided As Is

The site and everything on it are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the site will be available, uninterrupted, secure or free of errors.

12. Limit of Liability

To the fullest extent the law allows, Phins and the people who run it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost money, lost profits, lost data or betting losses, that come from your use of the site or your reliance on anything on it, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for all claims about the site is limited to the greater of fifty US dollars ($50) or the amount you paid us in the twelve months before the claim. Some places do not allow some of these limits, so parts of this section may not apply to you.

13. Your Responsibility to Us

You agree to defend and cover Phins and the people who run it against any claims, losses and costs, including reasonable legal fees, that come from your breaking these terms or misusing the site.

14. Changes

We may change, pause or end any part of the site at any time. We may also update these terms. The date at the top shows the latest version, and continuing to use the site after a change means you accept it.

15. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its rules on conflicts of law. Any dispute about the site or these terms will be brought only in the state or federal courts located in Pennsylvania, and you agree to those courts.

16. General

If a court finds part of these terms unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. These terms, with the Privacy Policy and the Disclaimer, are the whole agreement between you and Phins about the site.
